That would depend on a few things. Getting the site design approved can take a couple of days, depending through the number of iterations the process goes. On average that takes about 4 - 7 working days to complete. Once the basic design for the site is approved it takes about 48 hours to set up the actual site to get to the point where a client can start entering their content.

No. Shine will only host FlexiShell on it's own servers. The environment has been customized to run FlexiShell at optimal performance and has been fine tuned to give you and your clients the best possible experience on the system. It also minimizes the risks of outside intrusions and other threats.

No. For a variety of reasons access to the source files are denied for anyone besides staff. This is to protect our clients from potential security breaches and to protect our product. We can think of many reasons not to grant access to third parties; however it's the reasons we cannot think of that we just don't do it.

It's very important to understand that what you are paying for is a content management system. This means that you, as a client are responsible for your own content. The system was designed to be as easy as possible to use for novice users to put power back in your hands when it comes to all important content updates. This doesn't mean we leave you high and dry. Shine Interactive will set up the basic structure to your site to get you started and to give you an idea of how the site works as part of the setup costs. We will also make changes on your behalf for up to 3 hours a month. After this, we will invoice such changes. We will also provide you with training to get to know the tools. This is however a basic setup, and does not include the ongoing alteration of content over an extended period of time. |:Should you require the generation of content by means of copy writing or image authoring, Shine Interactive can assist at additional costs. Shine charges copy and image alterations at standard design rates of R450 per hour, excluding VAT. There is also the option to set up an ongoing retainer with Shine Interactive if your content changes often and you do not want to take the responsibility to alter the content yourself. This comes into effect if we work much more than 3 hours a month on your content.

Shine Interactive will suspend your FlexiShell site if you fail to make payment for more than 2 months hosting. We will continue to invoice your hosting fees until such time that we have received a cancellation notice in writing.

A reactivation fee of R950 excl. needs to be paid to re-activate your account. We will invoice this fee once you have settle all outstanding amounts in full. The activation fee must be paid in full before the site is reactivated.

The Client agrees:
- The implementation of FlexiShell Core Compact, Core Essentials or Core Complete is governed by these Terms and Conditions. These terms and conditions may change from time to time without prior notice at the discretion of Shine Interactive.
- FlexiShell Core remains the property of Shine Interactive.
- FlexiShell Core is designed to provide a platform and interface to facilitate the content management process on behalf of the client or by the client themselves.
- The Client has no right or entitlement to any of the source code contained within FlexiShell.
- Adapting code which involves the common functionality of FlexiShell Core is on a merit basis decided by Shine Interactive. Such adaptions will be evaluated in the light of the greater good of the product and will become available to all customers using the product.
- The Client will not enjoy the privileges to access source code online via FTP or any other means of access. Access is reserved exclusively to Shine Interactive who is tasked with the implementation and upkeep of the product.
- New common utilities which does not involve client company trade secrets or constitutes a uniquely customized module for a particular client's use, will be included as an option to all clients as an expansion option. An example of such a feature would be a blog function or opinion poll.
- FlexiShell Core will only be hosted on Shine Interactive's servers. Under no circumstance will Shine install the software on 3rd party servers as a request by client.
- Should the client insist on a 3rd party server the client shall require a dedicated hosting server. Such a server will be maintained and managed by Shine Interactive and within data centers of Shine Interactive's choosing. Should the client insist on a server on premises, Shine Interactive will enjoy access to such a server, either physically or via FTP at all times. The server shall under no condition be allowed to host any other software besides that which is required to run Linux, Apache, PHP, MySQL and FlexiShell. Under no conditions will FlexiShell be implemented on a windows based system. Shine Interactive will take absolutely no responsibility for the slow running or bad performance of FlexiShell on such an arrangement. Additional maintenance fees will also be raised on a monthly basis.
- Shine Interactive claims no ownership of any articles, databases, content, competitions, pages, users, user's personal data, video, audio, documents published or any other information gathered in the process of setting up the site or the due course of the site. Information will be extracted and made available via reports to the client on request.
- The client shall make no claim on any of the databases that governs the functionality of the product and is seen as part of the Core contributing to proper working of the product.
- The client shall not under any circumstance publish content which is seen as unt to minors, pornographic in nature, constitutes slander, political propaganda, displays acts of violence or the breaking of any law as governed by the Republic of South Africa and the United Nations International Law.
- The client shall not publish content of any nature of which it is not the rightful copyright owner. If such content is required to be published, ownership needs to be explicitly stated under the content and the rightful owners credited for such content. Where any institution needs to be paid for the rights to use such content, the responsibility falls to the client to pay such licensing fees to the governing body before the publishing of such content. The infringement of such copyright will be reported and handed over to the proper authorities.
- Shine Interactive reserves the right to delete content it sees as an infringement of law, moral debate, sexually explicit, slander, political propaganda or bad taste.
- Neither Shine Interactive nor any of it's employees claims liability to any content published. Such content includes text based articles, images, photographs, audio clips, video clips and any other form of transmission not mentioned. The publish of any such content in question will be the liability of the client and any judicial action resulting in the publish of such content will fall to the client's responsibility to deal with. Where such content is published by Shine Interactive on behalf of the client, Shine Interactive will merely act as a conduit.
- As part of the service offering, Shine interactive will maintain and update content on behalf of the client for up to 3 hours a month. Any additional time spent will result in the negotiation of a retainer to maintain such content.
- In the case of content generation, Shine Interactive levy such costs either by absorbing it on an ongoing basis into the negotiated retainer, or be invoiced on an individual basis. This includes the writing of copy, generation of images, the taking of photos or any other creative act to produce content.
- Shine Interactive will treat all user data as condential. Under no circumstance will we sell or cross-pollinate user data from one client to another. Shine Interactive under no circumstance will sell user data of any client to a third party.
- Shine Interactive reserve the right to use the public site as part of the promotion of FlexiShell. Shine Interactive also reserves the right to include copyright and development notices at the bottom of the site in a visible area to the public.
- FlexiShell is fully indexed by most search engines such as Google. Shine however does not take responsibility for any delays, lengthy processes implemented by such search providers in the caching of web pages. Shine Interactive also takes no responsibility for the actual content cached on pages.
- As part of the setup processes of any of the FlexiShell Core products, the following shall apply:
- 1. A chosen domain name will be registered on behalf of the client.
- 2. A site look and feel will be implemented. Such a look and feel can either be supplied by the clientthemselves, or will be designed by Shine Interactive based on the client's Corporate Identity.
- 3. One of Shine Interactive's servers will be prepared to accept the site and be managed on behalf of the client by Shine Interactive on an ongoing monthly basis.
- 4. Basic content as supplied by the client will be added to the site initially by Shine Interactive.
- 5. A training session on how to manage content on the site will be provided to the client on request.
- As part of the ongoing maintenance of any of FlexiShell Core products the following shall apply on a monthly basis.
- 1. A monthly invoice will be presented to the client. This invoice will become immediately payable by the client. The latest date of payment of a presented invoice will be the last day of the month the invoice is issued in.
- 2. Failure to pay invoices of two or more invoices will result in the immediate suspension of the service.
- 3. All outstanding invoices plus an additional penalty fee of R950 excl. VAT will be settled in full before the site is reactivated.
- 4. Shine Interactive will continue to invoice on a monthly basis until an ocial request of cancellation is presented in writing by the authorized representative of the company in question.
- 5. Included in any invoice, Shine Interactive will invoice the usage of the server, upkeep of FlexiShell, bandwidth used up to the rst 2GB trac usage.
- 6. The maintaining of content on behalf of the client up to 3 hours a month. Any additional time spent will be subject to the implementation of a retainer and will be negotiated separately from this terms of usage.
- 7. In the case of the e-commerce module installed, a minimum of R150 a month excluding VAT will be invoiced and shall include the rst 100 transactions on the site. Any additional transactions shall be invoiced at R0.80 ex VAT per transaction.
- 8. In the case of bulk SMS module or advertising module additional costs will become payable in the form of an impressions bundle or SMS bundle. Such amounts shall be negotiated on an ongoing basis to provide the client with the best possible value for money.
- 9. Databases are backed up on a regular basis.
- 10. Any additional retainer amounts shall be invoiced on a monthly basis.
- As part of the annual upkeep of FlexiShell Core, the following shall apply.
- An annual license renewal fee shall be charged at R1200 ex VAT.
- This fee shall include the domain renewal costs.
- This fee shall include any updates that may have become available and not been implemented during the year.
- Additional security is available in the form of SSL certicates and will be invoiced separately based on the required certicate cost. Additional setup fees may apply, depending on the complexity of such implementation.
- Where additional development is required with FlexiShell Core Compete, a proposal will be drawn up based on the client's needs. Such development is intended for the sole use by the client and may or may not be bound by condentiality agreements. Either way, Shine treats such development as condential at all times.
- Additional development is subject to development costs and may vary depending on the required implementation, the level of customization, complexity, database design, development duration and other factors contributing to cost.
- Third party resources may be integrated into such development and any associated costs will fall to the client's responsibility. In such instances the client will be liable for costs and can be directly settled with the 3rd party in question. Shine interactive will however chargea 10% handling fee on negotiating such contracts with 3rd parties.
- Payment is due in full in the case of FlexiShell Core Compact and FlexiShell Core Essentials before development commences. In the case of a FlexiShell Core Complete implementation a 50%, non-refundable deposit is required before work commences.
- Neither party shall be liable in damages or have the right to terminate this Agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including, but not limited to Acts of God, Government restrictions (including the denial or cancellation of any export or other necessary license), wars, insurrections and/or any other cause beyond the reasonable control of the party whose performance is aected (including mechanical, electronic, or communications failure).
- Neither party shall be liable for any failure or delay in performance under this Agreement (other than for delay in the payment of money due and payable hereunder) to the extent said failures or delays are proximately caused (I) by causes beyond that party's reasonable control and occurring without its fault or negligence, including, without limitation, failure of suppliers, subcontractors, and carriers, or party to substantially meet its performance obligations under this Agreement, provided that, as a condition to the claim of non-liability, the party experiencing the diculty shall give the other prompt written notice, with full details following the occurrence of the cause relied upon. Dates by which performance obligations are scheduled to be met will be extended for a period of time equal to the time lost due to any delay so caused.
